Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at wallythewrench.com (the “Site”) and the services provided by Wally The Wrench LLC (“we,” “our,” or “us”). By accessing the Site, booking a service, or otherwise engaging with us, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Services.
2. Services
We provide mobile automotive maintenance and repair services performed by independent contractor technicians at the customer's designated service location, subject to availability and these Terms.
3. Booking and Scheduling
Service appointments are confirmed only upon written or electronic acknowledgment from us. Arrival windows are estimates and may vary due to factors outside our control.
4. Pricing and Payment
Published pricing reflects standard service scenarios. Final pricing may vary based on the vehicle, condition, parts, or scope of work required. Any variation will be communicated and authorized prior to performance. Payment is due upon completion of service. Accepted payment methods are disclosed at the time of booking and may change from time to time.
5. Guarantees and Refunds
Service-specific guarantees, when offered, are subject to the terms published with the offer at the time of booking. Refunds, where applicable, are processed to the original payment method within a commercially reasonable timeframe.
6. Cancellation and Rescheduling
You may cancel or reschedule a confirmed appointment without charge up to two (2) hours before the scheduled arrival window. Cancellations or no-shows occurring within two hours of the scheduled arrival window may be subject to a trip fee.
7. Customer Responsibilities
You agree to:
- Provide accurate information about the vehicle, location, and requested service
- Ensure the vehicle is reasonably accessible and the service location is safe and lawful for repair work
- Provide keys or access required to perform the service
- Disclose known safety hazards
- Authorize work prior to performance
We reserve the right to decline or discontinue service if a location is unsafe, if required access is not provided, or if the requested service is outside the scope of services we offer.
8. Independent Contractors
Services are performed by independent contractor technicians dispatched by us. Independent contractors are not employees, agents, or partners of Wally The Wrench LLC except as expressly stated in these Terms or a written agreement.
9. Warranty
Parts are covered by the applicable manufacturer's warranty. Labor performed by us is warrantied for thirty (30) days from the date of service against defects directly attributable to the work performed, excluding damage caused by subsequent events, customer-caused damage, or failures of unrelated components. Warranty claims must be made in writing within the warranty period.
10. Disclaimer of Other Warranties
Except as expressly stated in Section 9, services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to a service shall not exceed the amount paid for that service. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of profits, towing costs, alternative transportation, or lost wages. Nothing in this Section limits liability that may not be limited under applicable law.
12. Indemnification
You agree to defend, indemnify, and hold harmless Wally The Wrench LLC, its officers, contractors, and affiliates from any third-party claim arising from your provision of inaccurate information, breach of these Terms, or unsafe direction provided at the service location.
13. SMS Communications
By providing a mobile number through our booking form, by texting us, or by otherwise consenting, you agree to receive text messages as described in our Privacy Policy. Reply STOP to opt out. Message and data rates may apply.
14. Intellectual Property
All content on the Site, including names, logos, marks, text, graphics, and software, is owned by or licensed to Wally The Wrench LLC and is protected by applicable intellectual property laws. No license or right is granted by implication.
15. Acceptable Use
You agree not to use the Site or our services to (a) violate applicable law, (b) infringe the rights of others, (c) introduce malicious code, (d) interfere with the operation of the Site, or (e) attempt unauthorized access to any system or account.
16. Modifications
We may modify these Terms at any time. The “Last updated” date reflects the most recent revision. Continued use of the Site or services after a modification constitutes acceptance of the modified Terms.
17. Governing Law and Venue
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Cumberland County, North Carolina, and you consent to personal jurisdiction in those courts.
18. Informal Dispute Resolution
Before initiating formal legal action, you agree to first contact us at the address in Section 21 to attempt to resolve the dispute informally. We will respond within fourteen (14) days of receipt.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any service-specific terms referenced at the time of booking, constitute the entire agreement between you and Wally The Wrench LLC regarding the subject matter.
